I.Price of Accommodation Services and terms of payment

1.1. The price of Accommodation Services is specified in the Operator's Price List.

1.2. The price of accommodation services includes: bed linen, towels, final cleaning, normal consumption of electricity and water, basic hygiene needs.

1.3 The price does not include the OU fee of 20 CZK/day/person over 18 years of age. This fee will be paid in cash to the Operator at the start of the stay according to the number of Clients.

1.4. The deposit for the price of the Accommodation Services is paid in the manner and within the period according to paragraph 4.2. The General Terms and Conditions and, in the event of the conclusion of the Agreement, constitute the first part of the price of the Accommodation Services. The Customer undertakes to pay the second part of the price of the Accommodation Services to the Operator in cashless form so that the payment is credited to the Operator's account no later than on the day the accommodation starts or in cash on the day the accommodation starts. In the event that the second part of the price is not paid within the period specified in this paragraph, the Operator is entitled not to provide the Client with Accommodation Services and the Customer undertakes to pay the cancellation fee in the amount specified in paragraph 7.5. 1.5. Upon arrival (or even during accommodation), the Operator is entitled to demand payment (deposit) of a deposit in the amount of CZK 5,000 from the Client to ensure the Operator's right to compensation for any damage or part thereof caused by the Client during the accommodation. In the event that the Client does not cause damage to the Operator during the accommodation, the Operator is obliged to return the deposit to the Customer at the end of the stay, in the same way as it was deposited (in the case of non-cash payment within 5 working days to the account from which it was deposited). In the event that the Accommodation Facility is left in a heavily soiled condition, a cleaning fee of CZK 1,000 will be deducted from the deposit. In the event that the Client causes damage to the Operator during the accommodation, the Operator is entitled to set off his claim for compensation for damage or parts thereof against the Customer's claim for the return of the security deposit. If the amount of the damage exceeds the paid deposit, the Customer is obliged to reimburse the Operator based on the Operator's invoice for the arrears of damage. In the event that the deposit is not paid within the period specified in this paragraph, the Operator is entitled not to provide Accommodation Services to the Client and the Customer undertakes to pay the cancellation fee in the amount specified in paragraph 7.5. GTC The customer is obliged to compensate the Operator for the damage caused even if the Operator does not use its right to pay (deposit) the deposit. Damage is paid on the basis of the Operator's invoice.

II. Cancellation Policy

2.1. The Customer is entitled to cancel the Accommodation Services before the start of the accommodation, in writing via an e-mail message sent to the Operator's e-mail address info@duskovic-ubytovani.cz.

2.2. The amount of the cancellation fee is CZK 0 if the stay is canceled more than 30 days before the start of the accommodation.

2.3. The amount of the cancellation fee is 50% of the advance payment for cancellation of accommodation between the 30th and the 22nd day before its start.

2.4. The amount of the cancellation fee is 100% of the deposit  when the accommodation is canceled between the 21st and the 1st day before its start, or in the event that the stay does not take place.

2.5. The operator will set off its claim for the payment of the cancellation fee against the claim of the Customer for the return of the advance paid (the first part of the price of the Accommodation Services). Any overpayment will be returned by the Operator by non-cash transfer to the account from which the deposit was paid.

2.6. In the event that the Customer withdraws the Accommodation Services to an extent that is more limited than the scope of the agreed Accommodation Services (e.g. shorter accommodation period), the Operator does not return the difference to the Customer.

 

IIIComplaints about accommodation services

3.1. In accordance with the provisions of the law regarding the right to defects, the Accommodation Service may have a defect if it does not correspond to the Agreement, i.e. the description of the Accommodation Services on the website www.duskovic-ubytovani.cz.

3.2. A power outage does not constitute a defect in the Accommodation Services.

3.3. The customer has the right to complain about a defect in the accommodation service without undue delay after discovering it, but no later than within 3 days of the end of the accommodation.

3.4. The customer has the right to remove the defect (only if it is applied during the Accommodation Services) or a discount from the price of the Accommodation Services.

 

IV. Contract termination

4.1. The contractual relationship between the Operator and the Customer may be prematurely terminated by agreement of the parties, withdrawal from the contract or termination.

4.2. The customer cannot, in accordance with § 1837 letter j) Act No. 89/2012 Coll., Civil Code, to withdraw from the contract, however, he is entitled to withdraw due to a material breach of the contract by the Operator according to paragraph 8.1. and/or 8.2. GTC

4.3. The operator is entitled to terminate the contract in the event that the Customer or the Client violates their obligations under the Agreement and/or General Terms and Conditions, grossly violates their obligations despite a warning, or violates good morals, accommodates an unreported person, and/or in the event that the Customer does not pay the second part of the price Accommodation services according to paragraph 6.3. and/or deposit according to paragraph 6.4. GTC The operator has the right to flat-rate compensation for damage caused by early termination of the Agreement in the amount corresponding to 100% of the price of the unused Accommodation Services (including clause 7.7 of the General Terms and Conditions).

10.4. The customer can terminate the contract before the end of the agreed period. In such a case, the Operator has the right according to paragraph 7.7 of the General Terms and Conditions.
